PENGERTIAN, FUNGSI, TUJUAN DAN UNSUR - UNSUR NEGARA


1. Pengertian Negara
Negara adalah suatu organisasi yang di dalamnya terdapat rakyat, wilayah yang permanen, dan pemerintahan yang sah. Dalam arti luas negara merupakan sosial (masyarakat) yang diatur secara konstitusional (berdasarkan undang – undang) untuk mewujudkan kepentingan bersama.
Indonesia adalah sebuah negara yang wilayahnya terbentang dari Sabang sampai Merauke dengan luas wilayah kurang lebih km2, terdiri dari ribuan pulau besar dan kecil (sehingga disebut negara kepulauan) dan UUD’45 sebagai konstitusinya.
2. Fungsi dan Tujuan Negara
Fungsi atau tugas negara adalah untuk mengatur kehidupan yang ada dalam negara untuk mencapai tujuan negara. Fungsi negara, antara lain menjaga ketertiban masyarakat, mengusahakan kesejahteraan rakyat, membentuk pertahanan, dan menegakkan keadilan.
Tujuan negara Indonesia telah jelas tercantum dalam Pembukaan Undang – Undang Dasar 1945 alinea ke-4 yaitu :
      1.    Melindungi segenap bangsa Indonesia dan seluruh tumpah darah Indonesia.
      2.    Memajukan kesejahteraan umum.
      3.    Mencerdaskan kehidupan bangsa.
      4.    Ikut melaksanakan ketertiban dunia yang berdasarkan kemerdekaan, perdamaian abadi dan keadilan sosial.

Menjaga  ketertiban masyarakat adalah tugas seluruh rakyat bersama aparatur negara dalam hal ini adalah POLRI.
3. Unsur-Unsur Negara
Unsur-unsur suatu negara itu meliputi berikut ini.
a. Rakyat
Rakyat adalah semua orang mendiami wilayah suatu negara. Rakyat adalah unsur yang terpenting dalam negara karena rakyat yang mendirikan dan membentuk suatu negara. Rakyat terdiri atas penduduk dan bukan penduduk.
Penduduk, yaitu semua orang yang tinggal dan menetap dalam suatu negara. Mereka lahir secara turun-temurun dan besar di dalam suatu negara.
Bukan penduduk adalah orang yang tinggal sementara di suatu negara. Misalnya, turis mancanegara yang berkunjung ke Indonesia.
Penduduk dapat dibedakan menjadi warga negara dan orang asing. Warga negara adalah semua orang yang menurut undang-undang diakui sebagai warga negara. Sebaliknya, orang asing atau warga negara asing adalah orang yang mendapat izin tinggal di suatu negara, bukan sebagai duta besar, konsul, dan konsuler.
b. Wilayah
Wilayah merupakan tempat tinggal rakyat di suatu negara dan merupakan tempat menyelenggarakan pemerintahan yang sah. Wilayah suatu negara terdiri atas daratan, lautan, dan udara. Wilayah suatu negara berbatasan dengan wilayah negara lainnya. Batas-batas wilayah negara dapat berupa bentang alam contohnya sungai, danau, pegunungan, lembah, laut; batas buatan contohnya pagar tembok, pagar kawat berduri, patok; batas menurut ilmu pasti berdasarkan garis lintang, garis bujur.
c. Pemerintahan yang Sah
Pemerintahan yang sah dan berdaulat adalah pemerintahan yang dibentuk oleh rakyat dan mempunyai kekuasaan tertinggi. Pemerintahan yang sah juga dihormati dan ditaati oleh seluruh rakyat serta pemerintahan negara lain.
d. Pengakuan dari Negara Lain
Negara yang baru merdeka memerlukan pengakuan dari negara lain karena menyangkut keberadaan suatu negara. Apabila negara merdeka tidak diakui oleh negara lain maka negara tersebut akan sulit untuk menjalin hubungan dengan negara lain. Pengakuan dari negara yang lain ada yang bersifat de facto dan ada yang bersifat de jure.
Pengakuan de facto, artinya pengakuan tentang kenyataan adanya suatu negara merdeka. Pengakuan seperti ini belum bersifat resmi.
Sebaliknya, pengakuan de jure, artinya pengakuan secara resmi berdasarkan hukum oleh negara lain sehingga terjadi hubungan ekonomi, sosial, budaya, dan diplomatik.

1. Plato, dilukiskan dalam bukunya Republik. Hukum adalah sistem peraturan-peraturan yang teratur dan tersusun baik yang mengikat masyarakat.

2. Aristoteles, hukum hanya sebagai kumpulan peraturan yang tidak hanya mengikat masyarakat tetapi juga hakim. Undang-undang adalah sesuatu yang berbeda dari bentuk dan isi konstitusi; karena kedudukan itulah undang-undang mengawasi hakim dalam melaksanakan jabatannya dalam menghukum orang-orang yang bersalah.

3. Austin, hukum adalah sebagai peraturan yang diadakan untuk memberi bimbingan kepada makhluk yang berakal oleh makhluk yang berakal yang berkuasa atasnya (Friedmann, 1993: 149).

4. Bellfoid, hukum yang berlaku di suatu masyarakat mengatur tata tertib masyarakat itu didasarkan atas kekuasaan yang ada pada masyarakat.

5. Mr. E.M. Mayers, hukum adalah semua aturan yang mengandung pertimbangan kesusilaan ditinjau kepada tingkah laku manusia dalam masyarakat dan yang menjadi pedoman penguasa-penguasa negara dalam melakukan tugasnya.

6. Duguit, hukum adalah tingkah laku para anggota masyarakat, aturan yang daya penggunaannya pada saat tertentu diindahkan oleh suatu masyarakat sebagai jaminan dari kepentingan bersama terhadap orang yang melanggar peraturan itu.

7. Immanuel Kant, hukum adalah keseluruhan syarat-syarat yang dengan ini kehendak dari orang yang satu dapat menyesuaikan dengan kehendak bebas dari orang lain memenuhi peraturan hukum tentang Kemerdekaan.

8. Van Kant, hukum adalah serumpun peraturan-peraturan yang bersifat memaksa yang diadakan untuk mengatur melindungi kepentingan orang dalam masyarakat.

9. Van Apeldoorn, hukum adalah gejala sosial tidak ada masyarakat yang tidak mengenal hukum maka hukum itu menjadi suatu aspek kebudayaan yaitu agama, kesusilaan, adat istiadat, dan kebiasaan.

10. S.M. Amir, S.H.: hukum adalah peraturan, kumpulan peraturan-peraturan yang terdiri dari norma-norma dan sanksi-sanksi.

11. E. Utrecht, menyebutkan: hukum adalah himpunan petunjuk hidup –perintah dan larangan– yang mengatur tata tertib dalam suatu masyarakat, dan seharusnya ditaati oleh seluruh anggota masyarakat yang bersangkutan, oleh karena itu pelanggaran petunjuk hidup tersebut dapat menimbulkan tindakan oleh pemerintah atau penguasa itu.

12. M.H. Tirtaamidjata, S.H., bahwa hukum adalah semua aturan (norma) yang harus dituruti dalam tingkah laku tindakan-tindakan dalam pergaulan hidup dengan ancaman mesti mengganti kerugian jika melanggar aturan-aturan itu akan membahayakan diri sendiri atau harta, umpamanya orang akan kehilangan kemerdekaannya, didenda dan sebagainya.

13. J.T.C. Sumorangkir, S.H. dan Woerjo Sastropranoto, S.H. bahwa hukum itu ialah peraturan-peraturan yang bersifat memaksa, yang menentukan tingkah laku manusia dalam lingkungan masyarakat, yang dibuat oleh badan-badan resmi yang berwajib, pelanggaran mana terhadap peraturan-peraturan tadi berakibat diambilnya tindakan, yaitu dengan hukuman.

14. Soerojo Wignjodipoero, S.H. hukum adalah himpunan peraturan-peraturan hidup yang bersifat memaksa, berisikan suatu perintah larangan atau izin untuk berbuat atau tidak berbuat sesuatu atau dengan maksud untuk mengatur tata tertib dalam kehidupan masyarakat.

15. Dr. Soejono Dirdjosisworo, S.H. menyebutkan aneka arti hukum yang meliputi: (1) hukum dalam arti ketentuan penguasa (undang-udang, keputusan hakim dan sebagainya), (2) hukum dalam arti petugas-petugas-nya (penegak hukum), (3) hukum dalam arti sikap tindak, (4) hukum dalam arti sistem kaidah, (5) hukum dalam arti jalinan nilai (tujuan hukum), (6) hukum dalam arti tata hukum, (7) hukum dalam arti ilmu hukum, (8) hukum dalam arti disiplin hukum.

16. Dr. Soerjono Soekanto, S.H., M.A., dan Purnadi Purbacaraka, S.H. menyebutkan arti yang diberikan masyarakat pada hukum sebagai berikut:

a. Hukum sebagai ilmu pengetahuan, yakni pengetahuan yang tersusun secara sistematis atas dasar kekuatan pemikiran.

b. Hukum sebagai disiplin, yakni suatu sistem ajaran tentang kenyataan atau gejala-gejala yang dihadapi.

c. Hukum sebagai kaidah, yakni pedoman atau patokan sikap tindak atau perikelakuan yang pantas atau diharapkan.

d. Hukum sebagai tata hukum, yakni struktur dan proses perangkat kaidah-kaidah hukum yang berlaku pada suatu waktu.

e. Hukum sebagai petugas, yakni pribadi-pribadi yang merupakan kalangan yang berhubungan erat dengan penegakan hukum.

f. Hukum sebagai keputusan penguasa, yakni hasil proses diskresi yang menyangkut keputusan penguasa.

g. Hukum sebagai proses pemerintahan, yaitu proses hubungan timbal-balik antara unsur-unsur pokok sistem kenegaraan.

h. Hukum sebagai sikap tindak ajeg atau perikelakuan yang teratur, yaitu perikelakuan yang diulang-ulang dengan cara yang sama, yang bertujuan untuk mencapai kedamaian.

i. Hukum sebagai jalinan nilai-nilai, yaitu jalinan-jalinan dari konsepsi-konsepsi abstrak tentang apa yang siagap baik dan buruk.

17. Otje Salman, S.H.: dilihat dari kenyataan sehari-hari di lingkungan masyarakat mengartikan atau memberi arti pada hukum terlepas dar apakah itu benar atau keliru, sebagai berikut:

a. Hukum sebagai ilmu pengetahuan, diberikan oleh kalangan ilmuan.

b. Hukum sebagai disiplin, diberikan oleh filosof, teoritis dan politisi (politik hukum).

c. Hukum sebagai kaidah, diberikan oleh filosof, orang yang bijaksana.

d. Hukum sebagai Lembaga Sosial, diberika oleh filosof, ahli Sosiaologi Hukum.

e. Hukum sebagai tata hukum, diberikan oleh DPR. Dan eksekutif (di Indonesia).

f. Hukum sebagai petugas, diberikan oleh tukang beca, pedagang kaki lima.

g. Hukum sebagai keputusan penguasa, diberikan oleh atasan dan bawahan dalam suatu Instansi atau lembaga negara.

h. Hukum sebagai proses pemerintah, diberika oleh anggota dan pimpinan eksekutif.

i. Hukum sebagai sarana sistem pengandalian sosial, diberikan oleh para pembentuk dan pelaksana hukum.

j. Hukum sebagai sikap tindak atau perikelakuan ajeg, diberikan oleh anggota dan pemuka masyarakat.

k. Hukum sebagai nilai-nilai diberikan oleh filosof, teorotis (ahli yurisprudence).

l. Hukum sebagai seni, diberikan oleh mereka yang peka terhadap lingkungannya; ahli karikatur.

2.1 INDIVIDUAL
2.1.1 People as Individuals
     The individual is a person / a person as a whole. Whole is defined as a trait that can not afford to be divided. Is a unity between the physical and spiritual inherent in a person.
Every individual has a different hallmark of other individuals, such as physical form, intelligence, talents, desires, feelings and have a level of understanding / meaning of an object. 2.1.2 Human beings as social

2.2.2 Status and Role of Individuals in Society

In everyday life, everyone has different roles and tasks. The task of a different doctor with a teacher, farmer, driver or army / police. Thus a very important role and position of fatherly maintaining social balance and integrity. Position or status in society there are two kinds:

     Pancasila is the basis of human behavior because the value contained in Pancasila filled with religious values, values ​​of truth, virtue, moral values ​​and the beauty of living in a society.
